Image Marketing/99 On-Hold owns an extensive, fully licensed music library.
According to United States Copyright Laws, playing the radio on-hold is a "re-broadcast" and therefore, subject to music licensing fees owed to ASCAP, BMI and othermusic ownership groups. ASCAP and BMI actively seek out businesses playing radio on-hold. Strong judgments have been imposed against business owners for illegal use.
Copyright infringement also includes playing music CD's or cassette tapes on-hold. U.S. Copyright Laws state that playing music CD's or tapes on-hold is a "public performance" and subject to the same copyright infringements as playing a radio on-hold.
